The following terms and conditions apply to all transactions on www.cliftoncameras.co.uk The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.
1. Status of Terms
1.1 These terms constitute a legal document ("the Agreement"), which sets out the rights and obligations of you as a purchaser ("you"), and those of Clifton Cameras Ltd ("Clifton Cameras", "we" or "us"), in relation to the services and products offered by us through this site or any of the other sites owned by us. By registering for Clifton Cameras services, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services.
1.2 You agree to:
1.2.1 provide true, accurate, current and complete information about you as prompted by our registration form (such information being the "Registration Data"); and
1.2.2 maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Clifton Cameras has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Clifton Cameras has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the Clifton Cameras site (or any portion of it).
2. Place of performance and applicable law.
Clifton Cameras Ltd is a company registered in England. Unless otherwise specified, the materials on this site are directed solely at those who access this site from the United Kingdom mainland. Clifton Cameras makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement.
You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement.
3. Placing an order
3.1 When placing an order with Clifton Cameras Ltd you have to first agree with the terms and conditions prior to the completion of your order.
3.2 We consider the contract of sale to be formed at the point of despatch by us of your goods.
3.3 Goods supplied to you by Clifton Cameras will correspond with their prices and description (subject to E & OE). If at any time this is not the case Clifton Cameras will give you the right to reject the goods within a reasonable time period for a full refund.
3.4 In the unlikely event that an incorrect price is shown on our website Clifton Cameras reserves the right to abstain from fulfilling the order at that price. You will, of course, be notified, and at which point you will be informed of the correct price, and given the choice to proceed with the order. As our buying prices are subject to change periodically we may on occasion be unable to supply at the advertised website price, in this instance, we will contact you and inform you of the correct pricing where you will have the option to proceed with the order or cancel the order with a full refund.
3.5 As we use the latest 3D Authentication card processing technology by placing an order on this website your payment will be processed on completing the order form, if for any reason your order cannot be fulfilled we will, of course, return a full refund to you.
3.6 We can only accept payment from payment cards registered in the United Kingdom. If you want to purchase an item and reside outside of the UK please contact us through our contact page and we will advise you via email how to pay and the cost of delivery. 3.7 Pre-Orders placed with Clifton Cameras are done so based on the price information we have at the time of announcement. Periodically pricing can change prior to product launch and all pre-orders are accepted as a non-binding agreement to supply at the specified price published when pre-order is placed. All deposits are fully refundable at any point and any pre-order has the right to cancel.

4.1 You have the right to cancel your order from the point of placing your order until 14 days after receipt of your goods. This is the cooling-off period. All cancellations must be made by phone to 01242 339285 and confirmed in writing within 14 days of receiving the goods, quoting your order no and your postcode. We will then give you a cancellation number pertaining to your order for your reference. Any goods received that haven’t been cancelled in this way will not be dealt with under the cooling-off period.
4.2 The 14-day Cooling-Off period is not a 'try before you buy' period. Any products returned to Clifton Cameras under the Cooling Off Period must meet the requirements outlined in section 4.3.
4.3a Where Clifton Cameras have supplied goods to you, you must take reasonable care of the goods in your possession pending their return to Clifton Cameras. Clifton Cameras will only accept returned goods complete with their original packaging and which do not exhibit any signs of wear or tear. Any use of the delivered goods beyond that necessary to inspect the goods upon delivery), in accordance with the Consumer Contracts Regulations 2013, will invalidate your right to cancel the contract or may be subject to a restocking fee. When evaluating cameras, you agree to keep shutter actuations (pictures taken) to an absolute minimum. As shutter actuations are measurable, products with excessive actuations are not considered to be new. We deem that an excess of 30 shutter actuations is beyond that needed to fairly inspect goods during your cooling off period and in such circumstances, reserve the right to apply a restocking fee. For printer purchases, we are unable to accept a return under your Right to Cancel where ink has been loaded into the machine. This does not apply for returns under warranty.
4.3b Drone returns - Activities that constitute being 'used' include, but are not limited to, being charged, activated, flown, updated or installed. Once a drone product has been activated, it is considered used. A restocking fee will apply for returning drone equipment that has already been activated.
4.4 Where Clifton Cameras have supplied goods to you, these goods must be returned to Clifton Cameras Ltd, Returns Department, Unit A1B Staverton Technology Park, 2 Herrick Way, Staverton, Cheltenham GL51 6TQ or be available for collection by Clifton Cameras. The cost of returning goods is non-refundable, and where Clifton Cameras collects goods, the direct cost of such will be deducted from the refund. If an item is deemed faulty on arrival we will reimburse return carriage costs up to the value of £10 or offer to collect the goods from you. Any costs outside of this amount need to pre-authorised by us prior to sending. When returning goods to Clifton Cameras, we recommend using an insured and trackable service and one which requires us to sign for the parcel upon receipt.
4.5 Software returns - Software, Memory Cards and Flash Drives may only be returned if they are unopened and in their original packing. This policy is to avoid any potential breach of the Copyright Descriptions and Patent Act (CDPA) 1988. All opened software is exempt from return under the terms of the Consumer Contracts Regulations 2013. Software, Memory Cards or Flash Drives which arrive damaged or is physically faulty may be returned under our normal returns policy.
4.6 Once the notice of your cancellation has been received in writing Clifton Cameras will make a refund of the contract price to your debit/credit card or Paypal account used to purchase the goods. This will be done within 30 days of the date of cancellation. When finance has been used to make a purchase, Clifton Cameras will cancel your contract with the finance provider who in turn will refund any deposit paid to them. Please check the terms of your application or contact the finance provider for more information.
4.7 Where goods purchased from Clifton Cameras display a fault or defect, you should immediately contact Clifton Cameras to report the issue. All reported faults will need to be assessed by Clifton Cameras and in some cases, by the manufacturer or repair agent. Where goods have to be returned to the manufacturer or repair agent, Clifton Cameras cannot always provide a time frame for assessment and or work to be carried out. Under the Consumer Rights Act you have a legal right to reject goods that are of unsatisfactory quality, unfit for purpose or not as described, and get a full refund or an exchange. This right is limited to 30 days from the date you receive your product.
4.8 The cost of returning goods to Clifton Cameras for assessment under warranty may be payable by the customer, depending on the circumstances. Each reported fault will be assessed on a case by case basis.
4.9 Faults or damage deemed to have been caused by misuse or accidental damage will not be covered under the terms of warranty and the cost of assessment and repair of a product in these circumstances would be chargeable to the customer.
Your statutory rights are not affected.
5. Used Equipment Warranty Details
Unless otherwise stated, all second hand or used items sold by Clifton Cameras will be supplied with a limited warranty. This warranty is non-transferable and is valid for six months from the date of purchase for orders collected from the store, or, from the date of delivery for on-line & mail order items. The warranty covers parts and labour costs in relation to the repair of any fault which occurred during normal usage of the item. The warranty is subject to the exclusions set out below;
- accidental damage and misuse.
- wear and tear
- any faults caused by shock or fall, sand, dust, dirt, damp or corrosion, leaky batteries.
- fire, theft, attempted or otherwise, accidental or malicious damage, vandalism, corrosion, water contamination or ingress, frost, flooding or other adverse weather conditions.
- repair or cleaning by unauthorised personnel.
- faults that have occurred because you have not used, stored or handled the product properly or have not followed written instructions for using the product.
- damage or defect due to willful neglect or negligence by anyone other than us.
- faults relating to image sharpness of a lens that is clearly open to human judgment.
- faults occurring to items where parts are no longer produced, such that the item cannot be repaired.
- loss of quality, degradation of performance or actual damage that results from the use of spare parts or other replaceable items (such as consumables) that are neither made nor
- recommended by the manufacturer.
- faults that are due to the connection of other fittings or accessories to the product which neither we nor the manufacturer of the warrantied item, have not approved.
- lost or damage to any data whatsoever.
- loss or damage to consumables such as batteries and memory cards.
We reserve the right to repair, replace or refund goods under this warranty at our discretion.

The warranty is subject to proof of purchase is provided; therefore you should retain your sales invoice. We regret we are unable to cover any costs of any unauthorised repairs.
6. Content
6.1 Clifton Cameras shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this site. Clifton Cameras will only be liable for consequential losses within the contemplation of the parties.
6.2 Certain links in this site (typically a banner advert or icon) will lead to sites, which are not under the control of Clifton Cameras. When you activate any of these you will leave the Clifton Cameras site and Clifton Cameras has no control over and will accept no responsibility or liability for the material on any site, which is not under the control of Clifton Cameras.
6.3 By placing an order on the Clifton Cameras website you have the choice to opt into our email mailing list. We will only email you periodically with offers from Clifton Cameras that we feel may be of interest to you. If you do not want to be included in our mailing list then you can opt-out at any time by following the opt-out link included on all email newsletters or by emailing sales@cliftoncameras.co.uk We will not share any subscribers email or any personal details with any other third party.

7. Limitation of Liability
7.1 Nothing in this Agreement shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of Clifton Cameras.
7.2 Subject to clause
7.1, you agree that Clifton Cameras shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the Internet not under Clifton Cameras's direct control including, without limitation, damage for loss of business, loss of sales, non-payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where Clifton Cameras has been advised of the possibility of such loss or damage).
7.3 The only liabilities that Clifton Cameras can exclude are those arising from the following.
7.3.1 In cases where losses were not foreseeable to both parties when the contract was formed.
7.3.2 Where losses were not caused by any breach on the part of Clifton Cameras.
7.3.3 For any business losses, and/or losses to non-consumers.
7.3.4 Clifton Cameras 2 year warranty is provided as an addition for products that carry a one year warranty only. Where manufacturers offer their own two-year warranty or longer and registration is required to obtain this warranty it is the responsibility of customers to register for this extended warranty themselves. Clifton Cameras will not support warranty claims outside of a one year period if this registration has not been completed. Our 2-year warranty does not extend to consumables, batteries etc, please refer to the manufacturers' warranty terms for these items.
7.3.5 Clifton Cameras 2 year warranty is non-transferable unless otherwise stated by the relevant manufacturer.

Any shortages or damages must be reported to Clifton Cameras within 48 hours of receiving your delivery.
Where can I have my order delivered?
This depends on your payment method. If you are paying with a credit or debit card then we can only deliver your order to the registered address for the cardholder or to a UK registered business address. If you pay using PayPal then we will despatch goods to any address you have authorised within your account settings.
If you have placed an order and paid via online finance then we will only deliver to the address that the finance agreement was authorised from.
When do I qualify for Free Delivery?
All items over the retail price of £150 and under 30 kilos in weight qualify for free UK delivery. Any items that do not qualify will require postage fees paid by the customer.
Refused Delivery
If you have refused the delivery, a charge of £7 can be levied to cover the cost charged by our couriers to return goods to us.
Redirection
If you require a parcel to be re-directed after it has been despatched a charge of £15.95 will be levied.
Any shortages from deliveries or if goods have been received in a damaged state must be notified to us within 3 days of receipt.

10. Copyrights
All designs, text, graphics and their selection and arrangement on this site are the copyright of Clifton Cameras or its content providers. As a visitor to the Clifton Cameras site, you are licensed to copy electronically or to print portions of this site for your own personal, non-commercial use. Any other use of materials on this site without Clifton Cameras's prior written consent is strictly prohibited.
11. Software
11.1 Intellectual property rights in any software or any other copyrighted materials ("Software") and supporting documentation supplied by us to you remain our property or that of our licensors.
11.2 Without our written consent and without affecting any applicable statutory rights under the Copyright (Computer Program) Regulations 1992 (as amended, supplemented or replaced from time to time) you shall not and shall not permit any other person to:
11.2.1 disassemble, reverse engineer, decompile or in any other way interfere with the Software;
11.2.2 copy or modify the Software; or
11.2.3 create any new Software partly or wholly based on the Software.
11.3 Subject to the terms of this Agreement, you are licensed to use the Software and associated documentation non-exclusively, but only for the purposes identified on the site in relation to the Software.
11.4 You must not transfer, assign or sub-license your right to use the Software or attempt to do so.

12. Matters Beyond our Reasonable Control
Clifton Cameras shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightning, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.
13. Language
In the event of conflict or inconsistency between the terms of the English language version of this Agreement and any translation provided by us, the English language version shall prevail.
14. WEEE Recycling Scheme
Clifton Cameras offers our customers a free “Take Back” scheme for their old electrical and electronic equipment (EEE). This is done on a like-for-like basis, so if you buy a new camera from us (e.g) then you can return your old camera back to us (within 28 days) and we will recycle your returned EEE in accordance with the WEEE regulations.
Why recycle?
Unwanted electrical equipment is the UK's fastest-growing type of waste.
Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health.
To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed-out wheeled bin symbol) in your bin.

15. Battery Recycling Scheme
Under the Waste Battery Regulations, Clifton Cameras offer a take-back scheme for all portable waste batteries. You can return your waste batteries to our business premises in person (PLEASE DO NOT POST) situated at Clifton Cameras Ltd, Staverton Technology Park, Herrick Way, Staverton, Cheltenham, Gloucestershire, GL51 6TQ
Alternatively, you can find your local waste portable battery recycling facility at www.recyclenow.com
Most supermarkets and shops that sell batteries will have collection bins for used batteries, and some town halls, libraries or schools may also set up collection points. End-users may find stores in their local area more accessible.
17. Site Security
The entire checkout process for the Clifton Cameras website is held on a secure server using a verified SSL (secure socket layer) system for transferring data. If you click on the small padlock symbol at the top of your browser screen you will be taken to this site's security certificate.
Clifton Cameras Ltd is authorised and regulated by the Financial Conduct Authority and is the broker and not the lender. Our FCA registration number is 728300. Clifton Cameras Ltd offers credit products from Secure Trust Bank PLC trading as V12 Retail Finance. Credit is provided subject to affordability, age and status. Minimum spend applies. Not all products offered by Secure Trust Bank PLC are regulated by the Financial Conduct Authority.
